Terms of Service

1. Acceptance of These Terms

These Terms of Service (“Terms”) are an agreement between you and Pink Bunny Co. (“Pink Bunny Co.,” “we,” “us,” or “our”). They govern the Pink Bunny Co. website, testing programs, the My Daily Helper mobile application, downloadable and other digital products, physical products, personalized and custom-made products, purchases, support, and related offerings (collectively, the “Services”). By browsing, signing up or participating in testing, downloading, accessing, ordering, purchasing, submitting a custom request, or using any Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use, test, or purchase the Services. If a user or intended product recipient is a minor or cannot legally agree, a parent, legal guardian, caregiver, or other authorized adult must review and accept these Terms.

2. Children and Adult Supervision

My Daily Helper and some products may be used by children and people who benefit from support. A responsible adult must decide whether a Service or product is appropriate, supervise use as needed, manage device permissions, control sharing of personal information, follow product instructions, and inspect physical products for age, size, allergy, choking, sensory, or other safety concerns.

You represent that you have authority to enter information about another person, use a Service on their behalf, or order a personalized item for them. Purchases and custom-product requests must be made by an adult legally able to enter a contract. Schools, providers, and organizations are responsible for obtaining legally required permissions.

3. Our Services and Products

My Daily Helper may include profiles, visual schedules, Picture Communication, Sentence Builder, Phrase Board, First/Then supports, feelings check-ins, journal entries, Social Stories, calming resources and music, learning activities, rewards, calendars, ABA-session notes, medication and emergency information, caregiver controls, reports, notifications, exports, and encrypted backup and restore. It is a general support and organization tool and does not guarantee an educational, behavioral, medical, therapeutic, or other outcome.

The current App does not require a Pink Bunny Co. account. Core App information is stored locally. You are responsible for protecting the device, caregiver PIN, backup password, notifications, exports, and copies shared with other services. Pink Bunny Co. cannot remotely recover deleted local information or a forgotten backup password.

Digital Products may include downloadable printables, activity materials, visual supports, templates, stories, guides, and other electronic content. Physical Products may include games, cards, toys, plush products, learning tools, printed materials, and accessories. Custom-Made Products may include personalized apparel, hats, mugs, jewelry, identification accessories, printed goods, and other items made from customer-provided choices or materials.

Descriptions, colors, dimensions, materials, packaging, availability, compatibility, and features may change. Screen colors, handmade variation, production methods, device settings, and supplier changes may cause reasonable differences from photographs or samples.

Pink Bunny Co. Testing Program

Adults may sign up to be considered for voluntary testing of future Pink Bunny Co. apps, services, website features, digital resources, educational or caregiver tools, physical products, or custom-product ideas. Signing up does not guarantee selection, an invitation, access, compensation, or a particular opportunity. We may select testers based on compatibility, available devices, accessibility needs, experience, location, test goals, response history, or other reasonable project needs.

Testing is voluntary and unpaid unless a specific written invitation clearly states otherwise. Selected testers must follow the invitation and testing instructions; use only accounts and devices they own, control, or have permission to use; protect private invitations, access links, credentials, test files, and unreleased information; promptly report serious safety or security concerns; and provide honest, respectful feedback. Testers must not publicly distribute, copy, sell, publish, demonstrate, reverse engineer, or provide another person access to unreleased materials unless Pink Bunny Co. expressly permits it in writing.

App testing may require an active Google or Amazon account, a compatible Android or Amazon Fire device, access to the invited email address, installation through Google Play or Amazon Live App Testing, and enrollment for a requested period. A Google Play closed test may require testers to remain continuously opted in for a stated period. Store, device, platform, and separate invitation terms also apply. Pink Bunny Co. does not control third-party account eligibility, invitation delivery, platform availability, or store enrollment.

Test versions and prototypes are unfinished, may change without notice, may contain defects, may stop working, and may not be compatible with every device. Do not rely on a test app, service, or product for emergencies, medical care, safety decisions, supervision, preserving important data, or other essential needs. Back up appropriate data and avoid entering real names, health records, passwords, financial details, or other unnecessary sensitive information into a test unless the instructions specifically require information and it is safe and lawful to provide it.

A child may participate only under the direct supervision of the registered parent or legal guardian, who must control the account, invitation, installation, participation, and feedback. You may decline an invitation or stop testing at any time. Pink Bunny Co. may change, pause, end, or remove a participant from a test at any time for project, compatibility, safety, security, conduct, legal, or store-compliance reasons.

4. App and Digital-Product Licenses

Subject to these Terms and the applicable app-store, marketplace, and product-listing rules, Pink Bunny Co. gives you a limited, revocable, nonexclusive, nontransferable license to use the website, install and use the App on compatible devices you own or control, and use lawfully obtained digital products only within the license stated for the product. The App and digital products are licensed, not sold.

Unless a listing expressly grants broader rights, digital products are for personal and household use. A Caregiver & Classroom listing may grant one purchaser permission to use specified materials with one household, one classroom, or that purchaser's own active professional caseload and to print copies for direct students or clients. It does not permit sharing with coworkers, other classrooms, other providers, an entire school or organization, shared drives, email lists, or third parties.

No license allows resale, public redistribution, file sharing, posting downloads online, removal of ownership notices, mass production, commercial reproduction, sublicensing, modified resale, or use of Pink Bunny Co. content to train an artificial-intelligence system. You may not reverse engineer, bypass security, extract source code, create an unauthorized derivative work, or commercially exploit the App, website, or digital products except where applicable law expressly permits it. Mandatory app-store or marketplace terms control if they conflict with this section.

5. Content, Creation Tools, and Materials You Provide

Pink Bunny Co. may create and refine products using original human work, licensed assets and software, and modern digital creation tools. Published materials remain subject to human selection, editing, accessibility consideration, and quality review. The use of a creation tool does not change the license, ownership, safety limits, or permitted uses stated in these Terms.

Pink Bunny Co. does not submit customer, donor, tester, child, caregiver, support, order, health, or other personal information to generative content systems to create materials, and does not use customer submissions to train artificial-intelligence models.

You retain ownership of schedules, notes, journal entries, images, names, logos, artwork, measurements, instructions, and other materials you provide (“User Content”). You are responsible for having all rights, permissions, and consents needed for us to use that content, including permission from a parent or guardian when it concerns a child.

You grant Pink Bunny Co. a limited license to receive, reproduce, adapt, format, and use User Content only as reasonably necessary to provide the requested Service, prepare a proof, manufacture or personalize a product, fulfill the order, provide support, and meet legal obligations. We may refuse User Content or custom requests that are unlawful, unsafe, hateful, explicit, infringing, deceptive, or inconsistent with our brand or policies.

You are responsible for reviewing names, spelling, measurements, colors, sizes, addresses, and approved proofs before production. You are also responsible for maintaining appropriate backups of important files and App content.

6. Acceptable Use

You agree not to:

• Use the Services unlawfully, fraudulently, or to harm, exploit, harass, or endanger another person.
• Add, order, print, or share content that infringes privacy, publicity, intellectual-property, or other rights.
• Attempt to disrupt, overload, damage, or gain unauthorized access to the website, App, downloads, or related systems.
• Remove ownership notices, copy product designs for resale, or misrepresent affiliation with Pink Bunny Co.
• Use My Daily Helper as an emergency-monitoring system or as the sole means of supervising a child or vulnerable person.
• Use automated methods to scrape or extract content except as expressly permitted by us.
• Resell products as new or authorized Pink Bunny Co. goods without our written permission.

7. Medical, Behavioral, Educational, Product, and Emergency Disclaimer

My Daily Helper, the website, and Pink Bunny Co. products do not provide medical advice, diagnosis, treatment, psychotherapy, behavioral therapy, legal advice, or individualized educational services. Information, tools, visual supports, toys, games, accessories, and other products are for general support, organization, education, recreation, or convenience only.

Always seek advice from a qualified professional regarding medical, developmental, behavioral, educational, allergy, choking, sensory, safety, or mental-health concerns. Follow all labels and instructions, select age-appropriate products, inspect items before use, and discontinue use if an item is damaged. The Services are not an emergency system. If someone may be in danger or experiencing an emergency, contact local emergency services or an appropriate crisis resource immediately.

8. Orders, Purchases, Donations, Shipping, and Returns

Prices and payment

Prices, taxes, shipping charges, availability, and promotions may change before an order is accepted. You authorize the applicable app store, marketplace, or payment processor to charge the amount shown at checkout. We may correct errors, limit quantities, reject an order, or cancel and refund an order that cannot be fulfilled.

App-store purchases

If My Daily Helper or optional features are sold through Google Play or Amazon Appstore, billing, renewals, cancellations, and refunds are processed under that store’s terms and policies. You are responsible for securing the device and store account and enabling parental purchase controls.

Optional donations

Pink Bunny Co. may offer free or pay-what-you-can resources and invite optional donations through Square. A donation is voluntary, is not required to access a resource identified as free, and does not purchase ownership, expanded licensing rights, priority service, or a guaranteed product or outcome. Donations are generally nonrefundable except where required by law or where a transaction was unauthorized or processed in error. Square’s terms and privacy practices also apply.

Digital products

Digital products are licensed, not sold. Delivery may occur through a download link, email, account access, or another stated method. Because access can be immediate, digital purchases may be nonreturnable after download or access except where the file is defective, the listing states otherwise, the applicable marketplace permits a refund, or law requires one.

Physical products and shipping

Shipping and delivery dates are estimates, not guarantees. You are responsible for providing a complete, accurate delivery address. Risk of loss and title pass as provided by applicable law and the carrier’s terms. Report shipping damage, missing items, or an incorrect item promptly and retain the packaging and photographs when possible.

Custom-made products

Custom work may require design approval, full or partial payment, and additional production time. Production may begin after you approve the proof or specifications. Customer-requested changes after approval may require an additional fee and revised schedule. Because custom products are made for a specific customer, they generally cannot be returned or canceled after production begins unless defective, damaged, materially different from the approved proof, or return is required by law. Minor variations in color, placement, texture, dimensions, and handmade or production characteristics are not defects.

Returns and refunds

Any product-specific return policy shown at purchase is part of these Terms. To request assistance, contact us with the order details within the period stated in the listing. We may require photographs, return authorization, and return of the item. This section does not limit nonwaivable consumer rights.

9. App Stores and Third-Party Services

Your use may also be subject to the terms and privacy practices of Google Play, Amazon Appstore, device manufacturers, operating systems, text-to-speech providers, payment processors, marketplaces, hosting providers, email providers, printers, manufacturers, and shipping carriers. Those parties are responsible for their own services. Pink Bunny Co. is not responsible for third-party availability, delays, content, security, or practices except where applicable law provides otherwise.

Pink Bunny Co.—not Google or Amazon—is responsible for the App, its content, and App support, except to the extent an app store’s terms state otherwise. Google and Amazon are not parties to these Terms, do not sponsor or endorse Pink Bunny Co., and have no warranty or support obligation beyond their own applicable terms and legal duties.

10. Pink Bunny Co. Content and Ownership

The website, App, digital and physical product designs, custom-product templates, My Daily Helper name, Pink Bunny Co. name and logo, My Daily Helper Friends, artwork, characters, text, software, photographs, packaging, and other materials supplied by us are owned by or licensed to Pink Bunny Co. and protected by intellectual-property laws. No rights are granted except the limited licenses stated in these Terms or a product listing.

Feedback or suggestions may be used by Pink Bunny Co. without obligation, provided we do not identify you publicly without permission.

11. Suspension, Cancellation, and Termination

You may stop using the Services, leave a test, or uninstall the App at any time. Cancellation of an order remains subject to the order status, product listing, custom-production rules, and applicable law. We may suspend access, remove a tester, decline service, cancel an unfulfilled order with an appropriate refund, or terminate a license when reasonably necessary to protect users, comply with law or store requirements, address compatibility, conduct, security, or fraud risks, discontinue a test or Service, or respond to a material violation of these Terms.

Sections that by their nature should continue after termination—including testing confidentiality and restrictions, licenses and restrictions, ownership, payment obligations, disclaimers, liability limits, and general terms—will remain in effect.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the website, App, test versions, prototypes, digital products, physical products, custom-made products, and related Services are provided “as is” and “as available.” Pink Bunny Co. disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement. We do not promise uninterrupted operation, compatibility with every device, error-free content, preservation of test data, permanent availability, exact color matching, production release, or a particular personal, educational, behavioral, therapeutic, testing, or product outcome.

Any express warranty or remedy stated in a product listing applies according to its terms. Test versions and prototypes do not include a warranty unless a specific written testing invitation expressly provides one. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, Pink Bunny Co. and its owners, employees, contractors, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost data, profits, or opportunities; or harm resulting from reliance on the Services, misuse of a product, failure to follow instructions, third-party services, carrier delays, unauthorized access, device failure, or loss of User Content.

Where liability cannot be excluded, our total liability for a claim will not exceed the amount you paid to Pink Bunny Co. for the App, product, order, or Service giving rise to that claim during the 12 months before the event. These limits do not apply where prohibited by law and do not limit nonwaivable consumer rights.

14. Changes to the Services or These Terms

We may update our website, App, products, and these Terms to reflect new offerings, safety needs, legal requirements, or business changes. Updated Terms will be posted with a revised effective date. If required, we will provide additional notice. Continued use after an update becomes effective means acceptance of the revised Terms; an order already accepted remains governed by the terms applicable when it was placed unless law requires otherwise.

15. General Terms

These Terms are governed by applicable United States law and the laws of the state in which Pink Bunny Co. is legally established, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise. Before filing a claim, you agree to contact us and make a good-faith effort to resolve the concern informally.

If any provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our written consent; we may transfer them as part of a business transaction. These Terms, the Privacy Policy, applicable product listings, and any approved custom-product specifications form the entire agreement regarding the Services unless separate written terms apply.
